TERMS AND CONDITIONS OF SALE

1. INTRODUCTION & BINDING AGREEMENT

Welcome to the website of DRÖM LLC (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website, including any purchases of our products, such as the “Dreamframe” bed frame (collectively, the “Services”). By accessing our site or purchasing a product, you agree to be bound by these Terms. If you do not agree to these terms, please do not use our Services or purchase our products.

2. ORDERS, PRICING, & SALES TAX

Order Acceptance: We reserve the right to refuse or cancel any order for any reason, including product availability, errors in product or pricing information, or suspected fraud or unauthorized transaction activity.

Pricing & Tax: All prices are listed in USD. DRÖM LLC is a fully taxable business entity and is not tax-exempt. Applicable state and local sales taxes will be calculated and added to your total order amount at checkout based on the delivery destination as required by applicable state regulations.

Pricing Errors: In the event that a product is listed at an incorrect price due to a typographical, system, or administrative error, we reserve the right to cancel any placed orders, even if the order has been confirmed and your payment method has been charged. If your payment method has already been charged, we will promptly issue a full refund to the original account.

3. SHIPPING, DELIVERY, & RISK OF LOSS

Shipping Scope: We ship exclusively to physical addresses within the contiguous United States. Shipping timelines, delivery dates, and tracking indicators provided at checkout or via correspondence are estimates only and are subject to third-party carrier delays, logistics constraints, and environmental disruptions.

Delivery Liability: Risk of loss and title for all products pass to you upon our delivery of the merchandise to the shipping carrier. DRÖM LLC is not liable or responsible for lost, stolen, misdirected, or delayed shipments once they have left our fulfillment facilities.

Freight & Heavy Packages: You explicitly acknowledge that our products ship in multiple heavy, oversized boxes. It is your sole responsibility to ensure safe physical receipt, transport from the delivery drop-off point into your residence, and a clear, safe path for handling.

4. STRICT NO-TRIAL & FINAL SALE POLICY

No Home Trials: DRÖM does not offer sleep trials, comfort guarantees, or “satisfaction or money back” return windows. All products are offered on a strict final-sale basis.

No Returns or Exchanges: We do not accept returns, refunds, or exchanges for customer style preference, wood grain variation, sizing/measurement errors, interior design mismatches, or physical comfort preferences. Please review all technical dimensions, clearances, and material specifications thoroughly before finalizing your purchase.

5. DAMAGED ON DELIVERY & MANDATORY PACKAGING RULE

Inspection Period: You must inspect all boxes and structural components immediately upon delivery. Any claims for transit damage, structural crushing, fracturing, or missing components must be reported to our customer care team within forty-eight (48) hours of carrier delivery.

Mandatory Box Retention: If a product arrives damaged from transport, you must retain all original shipping boxes, protective inserts, and packaging materials. DRÖM LLC cannot file carrier insurance claims, authorize reverse transit, or issue replacement structural components if the original packaging has been discarded or altered.

Resolution: Upon physical verification of delivery damage via photographic evidence, DRÖM will, at its sole discretion, either ship a replacement component or coordinate a full return and replacement of the frame at no additional cost to you, provided the original packaging remains completely intact for return shipping.

6. INTELLECTUAL PROPERTY

All content on this website—including but not limited to text, graphics, logos, images, proprietary joinery designs, industrial furniture designs, mechanical joint mechanisms, and proprietary assembly methodologies—is the exclusive property of DRÖM LLC and is protected by United States and international copyright, trademark, and patent laws. You may not reproduce, copy, reverse engineer, or exploit any portion of our structural designs, hardware mechanisms, or brand assets without express written consent from DRÖM LLC.

7. TWO (2) YEAR LIMITED WARRANTY

Scope: DRÖM LLC warrants to the original retail purchaser that the primary structural timber elements of the bed frame will be free from structural defects in materials and craftsmanship for a period of two (2) years from the initial date of delivery.

What is Covered: Complete structural failure of the wooden elements or mechanical failures of the proprietary joint locking mechanisms under normal, indoor residential (“bedroom”) use.

Exclusions: This limited warranty explicitly does not cover:

  • Cosmetic variations, natural wood grain shifts, mineral streaks, knots, minor color changes over time due to UV light exposure, or checking (minor superficial cracks) inherent to solid natural timber.
  • Damage caused by improper assembly, over-tightening of hardware, or failure to carefully adhere to the provided assembly instructions.
  • Damage incurred during customer relocation, disassembly, or secondary moving transit.
  • Commercial, institutional, hospitality, corporate rental, or non-residential use.

Remedy: Our sole and exclusive liability under this warranty is limited to repairing or replacing the specific defective structural component at our discretion.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DRÖM LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, PERSONAL INJURY, OR PROPERTY DAMAGE ARISING OUT OF OR RELATED TO YOUR USE OF THE PRODUCTS, REGARDLESS OF THE CAUSE OF ACTION. IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY EXCEED THE EXACT PURCHASE PRICE PAID BY YOU FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

9. GOVERNING LAW & DISPUTE RESOLUTION

These Terms and any dispute arising from or relating to them shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any legal action, suit, or proceeding relating to your access to, or use of, the site or purchase of products shall be instituted exclusively in the state or federal courts located in Palm Beach County, Florida. You hereby consent and submit to the personal jurisdiction of such courts.

10. PRIVACY POLICY & DATA COLLECTION

By utilizing our website, establishing a customer account, or finalizing a purchase of our products, you explicitly consent to the collection, aggregation, secure processing, and operational disclosure of your personal identifying information—including your legal name, billing credentials, verified shipping addresses, email communication points, primary telephone contacts, and encrypted transaction metadata—as comprehensively detailed within our standalone Privacy Policy.
